TERMS & CONDITIONS
The C Galleries NZ (The C Galleries Limited)
Last updated: September 2026
Welcome to The C Galleries NZ. By accessing our website or placing an order with us, you agree to the following Terms & Conditions. Please read them carefully before purchasing.
1. About Us
The C Galleries NZ is a New Zealand-based creative business offering original artwork, cakes, custom creations, gifts and related products.
Throughout these Terms & Conditions, “The C Galleries NZ”, “we”, “us” and “our” refer to The C Galleries NZ. “You” and “your” refer to the customer or person placing an order.
2. Products & Custom Orders
We take great care to ensure that all product photographs, descriptions, colours and measurements are represented as accurately as possible.
Because many of our products are handmade or individually created, slight variations may occur. These variations are part of the handmade nature of our work and do not constitute a defect.
For custom artwork, cakes and other personalised products, the final product may vary slightly from reference images due to the creative process, available materials, printing differences, lighting and screen settings.
Once a custom design has been approved or production has commenced, changes may not be possible.
3. Cake Orders
Cake orders are made specifically for each customer and are therefore considered personalised products.
Customers are responsible for providing accurate information, including:
* Required date
* Collection or delivery details
* Cake size
* Flavour
* Theme or design requirements
* Spelling of names and messages
* Any other personalised information
We are not responsible for errors resulting from incorrect information supplied by the customer.
Reference images are used for creative inspiration. We will aim to capture the requested theme, colours and overall style, but an exact replica cannot always be guaranteed.
Cake decorations may include edible images, fondant, wafer paper, chocolate, buttercream and other edible or decorative materials depending on the design.
4. Allergens & Dietary Requirements
Our products are prepared in a kitchen where common allergens may be present.
Products may contain or come into contact with ingredients including, but not limited to:
* Milk and dairy
* Eggs
* Wheat/gluten
* Soy
* Nuts and peanuts
* Other ingredients that may cause allergic reactions
Our products are not suitable for people with severe food allergies unless we have specifically confirmed otherwise in writing before the order is placed.
Customers are responsible for informing us of relevant dietary requirements or allergies before ordering. We will provide ingredient information where reasonably requested, but cannot guarantee an allergen-free environment.
5. Artwork & Creative Products
Original artwork, prints and creative products may vary slightly from images displayed online due to photography, lighting and screen settings.
Unless specifically stated otherwise, purchasing an artwork or product does not transfer copyright or intellectual property rights to the customer.
The C Galleries NZ retains copyright in original artwork, designs, photographs and creative concepts unless otherwise agreed in writing.
6. Customer-Supplied Images & Content
When you provide photographs, logos, artwork, characters, names or other content for a custom order, you confirm that you have permission to use that material for your order.
You remain responsible for ensuring that the content you provide does not infringe another person’s copyright, trademark, privacy or other rights.
We reserve the right to decline a custom request where we have concerns regarding the content provided.
7. Pricing & Payment
All prices displayed on our website are in New Zealand dollars (NZD) unless otherwise stated.
Prices may change from time to time. The price applicable to your order is the price displayed at the time your order is placed.
An order is not considered confirmed until payment has been successfully received, unless we have agreed otherwise in writing.
For custom orders, full payment or the required deposit must be received before production begins.
8. Custom Order Deposits & Payments
Where a deposit is required, the deposit secures the agreed date and production space for your order.
Because custom products are made specifically for you, deposits may be non-refundable where production has commenced or the cancellation occurs within a period where we are unable to reasonably reallocate the booking.
Any specific cancellation terms provided with your quotation or order will apply to that order.
9. Cancellations & Changes
We understand that plans can change. Please contact us as soon as possible if you need to cancel or change an order.
For personalised or custom-made products, cancellation or modification may not be possible once preparation or production has started.
If an order can be cancelled, any refund will be assessed according to the stage of production, costs already incurred and applicable New Zealand consumer law.
We reserve the right to retain amounts reasonably required to cover materials, preparation, production or other costs already incurred for a custom order, where permitted by law.
10. Delivery
We offer delivery to selected areas and may use our own delivery service or third-party courier services depending on the product and delivery location.
Delivery fees and available delivery areas will be displayed at checkout or confirmed before the order is accepted.
Customers are responsible for providing a correct and accessible delivery address and ensuring someone is available to receive the order where required.
For cakes and other fragile products, we strongly recommend keeping the product level, cool and secure immediately after delivery.
Once a product has been delivered to the nominated address and accepted by the customer or their nominated recipient, responsibility for appropriate storage and handling passes to the customer, except where otherwise required by law.
Delivery times are estimates and may be affected by traffic, weather, courier delays or circumstances outside our reasonable control.
11. Cake Storage & Handling
Cakes should be handled and stored according to the care instructions provided with the order.
Unless otherwise advised, cakes containing buttercream, cream, fresh fruit or other temperature-sensitive ingredients should be kept appropriately refrigerated.
We are not responsible for damage caused after delivery due to incorrect handling, transportation, storage, exposure to heat or failure to follow care instructions.
12. Order Acceptance
We reserve the right to decline or cancel an order where:
* The requested product or date is unavailable
* We are unable to fulfil the requested design
* The information supplied is incomplete or inaccurate
* A technical or pricing error has occurred
* Circumstances outside our reasonable control prevent fulfilment
If we cancel an order after payment has been received, we will arrange an appropriate refund in accordance with applicable law.
13. Returns & Refunds
Due to the personalised and perishable nature of many of our products, change-of-mind returns may not be available for custom cakes, personalised products or other products made specifically to your requirements.
This does not affect your rights under the Consumer Guarantees Act 1993 or other applicable New Zealand law.
If your product arrives damaged, incorrect or does not meet the guarantees required by law, please contact us as soon as reasonably possible with photographs and details of the issue so that we can assess and resolve the matter.
14. Damaged or Incorrect Orders
If you believe your order has arrived damaged, incorrect or defective, please contact us promptly.
For cakes and fragile products, photographs of the product and packaging may be requested to help us assess the issue.
Where an issue is caused by us, we will work with you to provide an appropriate remedy in accordance with applicable New Zealand consumer law.
15. Website Information
We make reasonable efforts to ensure that information on our website is accurate and current.
However, we do not guarantee that the website will always be error-free, uninterrupted or completely up to date.
We reserve the right to correct errors, update information and make changes to products, prices and availability without prior notice.
16. Intellectual Property
All original artwork, photographs, graphics, branding, logos, written content, designs and other creative material appearing on The C Galleries NZ website are owned by or licensed to The C Galleries NZ unless otherwise stated.
You may not reproduce, copy, modify, distribute, sell or commercially use our content without prior written permission.
17. Photography & Marketing
With your permission where required, we may photograph completed orders for our portfolio, website and social media.
If you do not wish your order to be photographed or used for promotional purposes, please let us know before or at the time of ordering.
18. Third-Party Services
Our website may use third-party services such as Shopify, payment providers, delivery providers, booking services and social media platforms.
Those services may have their own terms and privacy policies. We are not responsible for the policies or practices of third-party services outside our reasonable control.
19. Privacy
We respect your privacy and handle personal information in accordance with our Privacy Policy and applicable New Zealand privacy laws.
Personal information collected through our website may be used to process orders, communicate with customers, arrange delivery and provide services.
20. Events Outside Our Control
We will not be responsible for delays or inability to fulfil an order caused by circumstances beyond our reasonable control, including severe weather, natural disasters, transport disruption, power outages, supplier shortages, emergencies or other unforeseen events.
Where reasonably possible, we will communicate with you and work towards an appropriate solution.
21. Limitation of Liability
Nothing in these Terms & Conditions excludes, restricts or modifies any rights or remedies you may have under New Zealand law.
To the extent permitted by law, The C Galleries NZ will not be responsible for loss or damage caused by circumstances outside our reasonable control or by improper handling, storage or use of a product after delivery.
22. Consumer Rights
Nothing in these Terms & Conditions is intended to exclude or limit any rights you have under the Consumer Guarantees Act 1993, Fair Trading Act 1986, Privacy Act 2020 or any other applicable New Zealand legislation.
Where these Terms & Conditions conflict with a mandatory legal right, the applicable law will prevail.
23. Changes to These Terms
We may update these Terms & Conditions from time to time.
The latest version will be published on our website and will apply to orders placed after the updated Terms & Conditions become effective.
24. Contact Us
